Is there a Statue of Limitations?
My partner and I were together 7 years, I traded a auto that was in both of our names, she had to work that day and could not be there so I signed her name on the title, they told me I could, this was 5 years ago. Can she have me arrested for forgery? We recently broke up and she is doing everything she can to destroy me. Any help will be greatly appreciated.
She can press charges. The Cops will laugh at her. The District Attorney will never bring this case to trial. Do not admit to anything, do not lie. Exercise your 5th Amendment right to not incriminate yourself, don't make any statement at all to authorities.
5 years is too long to report this type of offense and be treated with seriousness. It was a car, She did not see it missing for 5 years? Did she accept payment?
Statute of Limitations varies from 2 years to about 7 years, depends on the crime, depends on the state. Most likely this wasn't even criminal, since she consented and you did not defraud anyone, but it may be civil, but that Statute of limitations is definitely gone for the civil side. she probably has no financial damage, anyway.
If she continues with these threats, it is blackmail. Get her to document the threat in an e-mail or in writing and then check the statute of limitations. If it has passed, then file a criminal complaint against her for blackmail or illegal threats.
